Privacy policy

Introduction

Binet Legal is committed to complying with the General Data Protection Regulation (abbreviated to RGPD), in force since 25 May 2018 and directly applicable to all actors active on the territory of the European Union.

1. Legal basis

The processing of personal data is only permitted if it is based on one of the legal bases listed in Article 6 of the RGPD, in this case, as far as Binet Legal is concerned:

  • The performance of the contract with the data subject (e.g. the mandate binding the lawyer to his client).
  • Compliance with a legal obligation.
  • The legitimate interests of the data controller.
  • Where applicable, the consent of the data subject.

2. Collection of personal information

If you wish to leave a message on the site using our contact form, you will be asked to provide notably your surname(s), first name(s) and e-mail address (hereinafter your ‘Personal Data’). By providing this information, you expressly agree to your Personal Data being processed by Binet Legal, for the purposes indicated in point 2 below.  If there are other purposes than those indicated in point 2, they will be communicated at the end of each form.

In general, your personal data is not automatically recorded when you browse the binetlegal.com website.

Our site uses cookies to improve your browsing experience and to analyse traffic. Some cookies may collect information that could be considered Personal Information, such as your IP address or device identifiers. When this is the case, the information is collected in compliance with the applicable legislation on the protection of personal data. You can manage your cookie preferences at any time through our consent banner or your browser settings.

3. Purposes of processing

Binet Legal may process your Personal Data:

(a) for the purpose of providing you with the information or services you have requested (in particular the follow-up of a request for services or a response following a contact request) ;

(b) for the purpose of collecting information enabling us to improve our site and our services (in particular by means of cookies).

4. Retention period

Your Personal Data is kept by Binet Legal for the duration of the contractual relationship between Binet Legal and the client.

Beyond that, in principle, the data should be archived for the period during which Binet Legal’s responsibility could be called into question before final deletion of the data, i.e. 5 years after completion of its mission.

5. Right of opposition and withdrawal

You have the right to object, to withdraw your Personal Data and to withdraw your consent. You may also request the transfer of your Personal Data.

The right to object is understood to be the possibility offered to Internet users to refuse that their Personal Data be used for certain purposes mentioned at the time of collection. You have the right to object to the processing of your Personal Data where such processing is based on a legitimate interest (yours or that of a third party), and where your objection is justified by reasons specific to your particular situation.

The right of withdrawal is understood to be the possibility offered to Internet users to request the deletion of their Personal Data. You also have the right to ask us to delete your Personal Data when you have exercised your right to object to the processing of such data.

Where you have provided consent to the collection, processing and transfer of your Personal Data for a particular purpose, you retain the right to withdraw your consent to such data processing at any time. Once we receive notification of your withdrawal of consent, we will no longer process your information for the purpose(s) for which you gave consent, unless we have a legitimate reason to do so.

You may request the transfer of your Personal Data to you or to another data controller in an electronic and structured format (right to data portability). This allows you to retrieve and transfer your data in an electronically usable format.

6. Right of access

Exercising the right of access makes it possible to find out whether personal data relating to the data subject is being processed and to obtain communication of this data in a comprehensible format. It also enables the accuracy of the data to be checked and, if necessary, rectified or deleted.

You may request access to your Personal Data. This request allows you to receive a copy of the Personal Data we hold about you and to check that we are processing this data lawfully.

You may also request information about whether we hold Personal Data about you and, if so, what that information is and why we hold/use it.

You may also request correction of the Personal Information we hold about you in order to rectify any information that is incomplete, inaccurate or simply out of date.

7. Right to limit processing

You may request that we restrict the processing of your Personal Data. This allows you to ask us to suspend the processing of your Personal Data, for example if you wish to establish the accuracy of or reason for processing the data.

8. Request to exercise rights

In order to exercise these rights, you may contact the data controller Marjorie BINET VALBON at the email address info@binetlegal.com.

Your request will be processed within one month once your identity has been confirmed.

You will not be charged for accessing your Personal Data (or for exercising any of your other rights). However, we may charge you a reasonable fee if your request for access is manifestly unfounded or excessive. We may also refuse to comply with your request for the same reasons.

We may ask you for specific information to help us confirm your identity and to ensure that your right of access to this information (or to exercise any other of your rights) is respected. This is a security measure designed to ensure that your Personal Information is not disclosed to anyone who is not authorised to access it.

9. Subcontracting

Binet Legal does not use any subcontractors.

10. Security

The Personal Data we collect is kept in a secure environment. Our staff is required to respect the confidentiality of your information.

We are committed to maintaining a high level of confidentiality by incorporating the latest technological innovations to ensure the confidentiality of your data. However, as no mechanism offers maximum security, a degree of risk is always present when using the Internet to transmit personal information.

11. Complaints
